Investor-state disputes involving early-stage projects have unique challenges, especially when long term, capital-intensive investments are disrupted by alleged state conduct. These situations raise complex legal and valuation questions, such as whether early-stage investments qualify as “investments”, the role of sunk costs and how tribunals affect future risks.
